These terms are an agreement between you and [legal name] ("Kleoma", "we", "us") about your use of the Kleoma mobile app (the "app") and the website kleoma.com. By creating an account or using the app you accept them. If you do not accept them, please do not use the app.
Our Privacy Policy explains how we handle personal data and is not part of these terms, but you should read it too.
1. Who we are
[legal name], [legal form], [address], [country], registration number [registration number]. You can reach us at support@kleoma.com. More details are in the legal notice.
2. Who may use Kleoma
- You must be at least 16 years old. The app asks you to confirm this.
- You must be able to enter a binding agreement where you live.
- One account is for one person. Please do not share your sign-in details.
3. Your account
- Give us accurate information and keep your sign-in details safe. You are responsible for what happens under your account.
- Tell us at support@kleoma.com if you think someone else has used it.
- You can delete your account at any time in the app (Settings, Data and privacy). See Data deletion. Deleting your account does not cancel a subscription bought through Apple or Google; cancel it in your store account.
4. What Kleoma is, and what it is not
Kleoma is a language-learning app built around listening. It plays short lessons, dialogues and word lists in spoken form, and helps you choose what to hear next.
- The voices are synthetic. The audio is generated by text-to-speech systems, not recorded by people. See our AI content notice.
- Some content is written with the help of AI. We check and improve it, but it can contain mistakes: wrong words, awkward phrasing, unnatural intonation. Please report errors at support@kleoma.com.
- No promise of results. Learning a language depends on you. We do not promise any level of fluency, test result or timeline.
- Not professional advice. Kleoma is for general education. It does not replace a teacher, an official exam preparation course or a certified translation.
5. Your licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on your own devices for your own non-commercial learning, in line with these terms and the rules of the app store you got it from.
6. What you may not do
- Copy, scrape, record in bulk, resell or republish the content or audio, or use it to train a machine-learning model.
- Reverse engineer, decompile or tamper with the app, except where the law gives you that right.
- Bypass or interfere with security, rate limits or access controls, or overload our services.
- Use the app for anything unlawful, or to harass others or send spam.
- Use automated means (bots, scripts) to create accounts or access the service.
If you break these rules we may limit or end your access.
7. Paid features
If the app offers paid features ("Premium"), the price, billing period and what is included are shown before you buy and are handled by the Apple App Store or Google Play. The conditions are in our Subscription terms. [DECISION: remove this section if the app is free at launch.]
8. Advertising
The free version of the app may show ads. Ads are provided by Google AdMob. How ad data is handled, and how you choose, is explained in the Privacy Policy.
9. Our content and your content
- The app, its design, text, audio and software belong to us or our licensors and are protected by copyright and other laws. These terms give you no ownership of them.
- "Kleoma" and our logo are our brand. Please do not use them without our written permission.
- If you send us feedback or ideas, we may use them without owing you anything.
10. Availability and changes to the service
We work to keep the app running, but we cannot promise it will always be available or error-free. We may update, change or stop features, for example to improve them, fix problems, or comply with the law. If we remove a feature you paid for, we will tell you and, where the law requires it, refund the unused part.
11. Ending the agreement
You can stop using Kleoma and delete your account at any time. We may suspend or end your account if you seriously or repeatedly break these terms, or if the law requires it. We will tell you why, unless the law forbids it. Sections that by their nature should survive (for example ownership and liability) continue after the agreement ends.
12. Our responsibility
- We are responsible for harm we cause intentionally or through gross negligence, for injury to life, body or health, and in every other case where the law does not allow us to limit responsibility.
- In other cases, and as far as the law allows, we are responsible only for foreseeable harm that results from breaking an essential obligation, and not for indirect or lost profit.
- The app and its content are provided "as is" as far as the law allows. Your rights as a consumer under mandatory law (for example the right to a product that conforms to the contract) are not affected by these terms.
13. Changes to these terms
We may change these terms, for example when we add features or when the law changes. We will give you reasonable notice of material changes in the app. If you keep using the app after the change takes effect, you accept the new terms; if you do not agree, you can stop using the app and delete your account. For changes that need your consent we will ask you again.
14. Governing law and disputes
These terms are governed by [governing law]. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring a claim in the courts there. Otherwise the courts of [courts] have jurisdiction. [VERIFY: a lawyer should confirm the governing-law and court wording for consumers in the EU.]
